Assistant Prosecuting Attorney – Marquette County

Essential Functions: Under the supervision of the Prosecuting Attorney and the Chief Assistant, reviews and authorizes requests for warrants, determines the appropriate charge and prosecutes misdemeanor and felony cases. Attempts to resolve and dispose of criminal cases or tries cases in court. May be responsible for managing the Probate Court caseload of the office. May also be responsible for managing Family Support cases. Reviews requests for search warrants and authorizes warrants as appropriate. Reviews applications for nondisclosure orders. Drafts investigative subpoenas when necessary.

In felony cases, prepares and appears in court on behalf of the People of the State of Michigan for probable cause conferences, preliminary examinations, motion hearings, trials, sentencings, and other proceedings. In misdemeanor cases, prepares for and attends pretrial conferences, motion hearings, final pretrial conferences, trials, sentencings, and other proceedings. Includes the research of applicable law, working with victims in compliance with the Crime Victim’s Rights Act, interviewing witnesses, using
professional judgment in assessing the strength of available evidence, directing law enforcement officers to follow up when necessary in ongoing investigations, formulating and negotiating plea offers and/or sentence agreements, and developing trial strategies.

Participate with specialty and treatment courts and programs, including Drug Court, Sobriety Court, Veteran’s Court, Truancy Court, Job Court, Juvenile Treatment Court, and jail diversion programming.

Serve in an on-call capacity to review requests for arrest and search warrants and provide information and advice to law enforcement, social services, mental health providers, Child Advocacy Center staff, and others on proceedings and matters under investigation.

Education: Law degree from an accredited law school.

Other Requirements: Licensed to practice law in the State of Michigan.

Salary Range:
APA I: $25.27 – $30.83 hourly (with benefits and on-call pay)
APA II: $30.67 – $37.41 hourly (with benefits and on-call pay)
